Kulturely Marketplace Terms
These terms govern use of Kulturely by guests and hosts. Kulturely is operated by KULTURELY LTD, company number 16877179, whose registered office is 124-128 City Road, London, England, EC1V 2NX ("Kulturely", "we", "us"). Contact: [email protected].
1. The marketplace
Kulturely provides a marketplace where independent hosts can describe and offer cultural experiences to guests. Unless a listing expressly identifies Kulturely as the supplier, the host supplies the experience and is responsible for delivering it lawfully, safely and as described. Kulturely operates the marketplace, processes bookings, provides support, and may moderate listings and users.
When a booking is confirmed, a contract for the experience is formed between the guest and host. These terms, the listing, the Cancellation Policy, the Guest and Host rules, and any mandatory information shown at checkout form part of that contract. Nothing in these terms removes rights that cannot lawfully be excluded.
2. Eligibility and accounts
You must be at least 18 and able to enter a binding contract. Information supplied to Kulturely must be accurate and kept current. You are responsible for your login credentials and activity on your account. Tell us promptly if you suspect unauthorised access.
Kulturely may require email, phone, identity, business, tax or payout checks. A badge or completed Stripe check is not a guarantee of conduct, skill, safety or suitability.
3. Listings, booking and payment
Hosts control their experience description, price, lawful capacity and availability, subject to Kulturely’s standards and moderation. Guests must review the listing, accessibility information, requirements, location disclosure and cancellation terms before booking.
At launch all prices are in GBP. The complete mandatory guest price is shown before purchase and consists of:
- the host-set experience subtotal; plus
- a Kulturely guest service fee equal to 10% of that subtotal.
Kulturely separately deducts a 10% host commission from the experience subtotal. The guest fee and host commission are not compounded. We do not add a fee merely because a consumer uses a particular payment method.
Stripe processes guest payments and host payouts. All guest-facing paid experiences use immediate payment, not request-to-book or host approval. To book, a guest chooses a future date and time allowed by the booking page and the number of guests, then has 10 minutes to complete payment while that selection is held. If payment succeeds within that period, the booking is confirmed immediately and the guest and host receive confirmation. If payment is not completed in time or fails, no booking is formed and the held selection may be released. By keeping an experience published, the host authorises Kulturely to accept and confirm paid bookings for the dates and times that its booking page allows. The host must update or unpublish the experience promptly if it is no longer available.
Stripe Connect payout onboarding and bank details are not prerequisites for listing an otherwise bookable experience or accepting guest bookings. A host must complete the required payout checks and provide withdrawal details before withdrawing earnings; earnings remain unavailable for withdrawal until then.
Earnings normally become eligible seven days after the experience. Any positive eligible balance is included in the next weekly automatic payout once Stripe withdrawals are connected. Refunds, disputes, chargebacks and lawful holds may delay eligibility, and Kulturely may set off refunds, chargebacks, unrecovered provider costs and other properly due amounts against host balances or future earnings.
Migrated listings
A listing imported from the former Kulturely service may be visible and offered for immediate payment when it has the required booking details, including a price, guest capacity and duration. Its host should sign in promptly to review and update its description, price, capacity, duration, location, media and the dates and times guests may choose. An imported listing that is missing required booking details cannot accept payment or receive a booking until those details are fixed and all bookability checks pass.
If a host no longer offers a particular imported experience, the host can sign in, open that experience and unpublish it. Unpublishing removes that experience from discovery and new bookings without deleting it or affecting the host’s other experiences. It does not cancel or otherwise change existing paid bookings.
4. Cancellations, refunds and changes
The Cancellation Policy applies to every booking and explains the contractual grace period, refund bands, rescheduling, no-shows and actual unrecovered payment-provider costs. A host cancellation or host no-show results in a refund of everything the guest paid; associated unrecovered provider costs may be charged to the host.
For leisure services supplied on a specific date or during a specific period, the statutory 14-day cancellation right will not normally apply. Kulturely nevertheless provides the contractual cancellation rights stated in the Cancellation Policy. Statutory remedies for services not performed with reasonable care and skill, or not supplied as agreed, remain unaffected.
5. Conduct and safety
Users must act lawfully and respectfully. Hate, harassment, exploitation, fraud, unsafe conduct, misleading claims, unlawful discrimination, prohibited content and attempts to move a Kulturely booking or payment off-platform are forbidden. Do not misuse personal data or share payment credentials.
Experiences involve real-world activity and may carry ordinary risks. Hosts must assess and control risks, maintain required licences and insurance, communicate allergens and material hazards, and provide reasonable safety instructions. Guests must follow lawful instructions, disclose relevant participation needs when necessary, and leave or seek emergency help if unsafe. Kulturely’s review and reporting systems reduce risk but cannot eliminate it.
6. Content and intellectual property
You keep ownership of content you upload. You grant Kulturely a worldwide, non-exclusive, royalty-free licence for as long as reasonably needed to host, reproduce, resize, adapt for accessibility or format, display, distribute and promote that content in connection with Kulturely. You confirm that you have the necessary rights, permissions and releases, including for identifiable people, music and locations. You may withdraw future promotional use by removing content, subject to completed bookings, legal retention and existing campaign commitments.
Kulturely’s brand, software and original content remain protected. You may not scrape, copy, reverse engineer or commercially exploit them except as law permits.
7. Search, promotion and moderation
Search ranking may consider relevance, location, availability, quality, safety, completeness, reliability and guest feedback. Safety, eligibility, quality and availability gates take priority over payment. A paid seven-day Boost is labelled “Promoted”, applies only to an already suitable listing and has a bounded effect; it cannot guarantee placement. Sponsored Host social-media promotion does not alter marketplace search ranking. Details of material ranking parameters are made available to hosts.
We may review, restrict, delist, suspend or terminate content or accounts where reasonably necessary for safety, illegality, fraud, policy breach, payment risk or marketplace integrity. Except where urgent action, law enforcement, fraud prevention or safety requires otherwise, business hosts will receive reasons and a reasonable opportunity to respond or appeal. 8. Reviews and messages
Only eligible completed-booking participants may leave transaction reviews. Reviews must be honest and relevant. Messages and user content may be automatically screened for safety, fraud, external payment details and prohibited material. Human access to reported conversations is limited to authorised case handling and is audited. Retention is described in the Privacy Notice.
Users can report a listing, profile, review, message or other content through the relevant in-product Report control or by emailing [email protected]. Reports may concern suspected illegality, threats, exploitation, fraud, harassment, hate, sexual content, child safety, privacy, intellectual-property infringement or another breach. Kulturely assesses reports proportionately, may preserve evidence, restrict visibility or access, remove content, suspend an account and contact emergency services, the National Crime Agency, law enforcement or another competent authority where required.
If you disagree with a content or account decision, use the in-product appeal route or email [email protected] with the decision reference. We will explain the outcome unless doing so would create a safety, fraud-prevention or legal risk. We keep records of reports, decisions, measures and reviews as required by applicable online-safety law. The individual accountable for Kulturely's online-safety compliance is identified in Kulturely's internal compliance record and can be contacted through [email protected].
9. Taxes and platform reporting
Hosts are responsible for registrations, licences, invoices and taxes arising from their activities. Kulturely may collect, verify, retain and report seller identity and transaction information to HMRC or another authority where digital-platform reporting or other law requires it. Kulturely does not provide tax advice.
10. Liability
Nothing excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that law does not permit us to exclude.
For consumers, Kulturely is responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for losses caused solely by a host or guest, losses that were not foreseeable when the contract was formed, or business losses suffered by a consumer. Your rights against the host as supplier remain intact.
For hosts acting in business, Kulturely is not liable for indirect or consequential loss, loss of profit, revenue, goodwill, anticipated savings or business opportunity. Subject to the non-excludable liabilities above, Kulturely’s aggregate liability to a business host arising in a 12-month period is limited to the greater of £100 and the Kulturely fees paid or payable by that host during that period. This cap does not reduce amounts Kulturely is required to remit as safeguarded or settlement funds under applicable payment arrangements.
11. Changes and termination
You may stop using Kulturely, subject to existing bookings, amounts due and retained records. We may amend these terms for legal, safety or product reasons. Material changes will be notified in advance where reasonably possible; business users will receive the notice required by applicable platform-to-business rules. Continued use after the effective date constitutes acceptance where lawful; fresh consent will be requested when required.
12. Governing law and complaints
These terms are governed by English law. Consumers may bring proceedings in the courts of the part of the United Kingdom where they live where mandatory law permits. Business disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
